The maximum sentence for poisoning an infant to death was twenty years in jail, according to several accounts. The lady who ran an unregistered day care out of a military station in Hawaii received the maximum sentence. The defendant, Dixie Denise Villa, was found guilty of manslaughter by the jury a month ago.
Anna Lobisch, the mother of Abigail, who is seven months old, was quoted as saying on Wednesday with The Military Times, “I’ll never hear her call me mama.”
Reportedly, authorities stated that Villa had been operating an illegal day care out of a residence located within the Aliamanu Military Reservation, which is a military base located on the island of Oahu. This was the case despite the fact that officials had shut down the facility on many occasions. All of these led to a sad conclusion on February 23, 2019. There was an overdose of diphenhydramine, which is an antihistamine and the active ingredient in the medication Benadryl. Abigail passed away as a result of this overdose. Those in charge of prosecution stated that children younger than six years old should never be given the medication without the authorization of a physician.
According to The Navy Times, Judge Faaunga To’oto’o stated that the quantity of Benadryl that was discovered in the blood system of baby Abi must not be administered to any child, much less to a baby who is seven months old. “Those are the facts that pertain to this occasion.”
According to reports, Anna Lobisch stated on Wednesday that it has been more than 2,260 days since the passing of her kid, and that “during all of that time, my heart has never stopped hurting.” The sorrow of living without Abi is a tremendous weight that I will bear every single day for the rest of my life until Abi and I are finally reunited. My life has been characterized by sadness and loss, and the pain of experiencing life without Abi is a heavy weight.
It was alleged that she stated Villa did not exhibit any remorse.
The request for probation was made by defense attorney Megan Kau. The argument that she made was that her client did not pose a threat to the general public. She stated that Villa had two children, one of whom had unusual characteristics. She stated that Villa is unable to provide care for the children while she is incarcerated.
It was claimed that Kau stated that a term of probation would be appropriate for Ms. Villa because it would demonstrate the gravity of the offense, encourage respect for the law, and serve as a kind of retribution.
It is said that Villa’s now-ex-husband, who is currently serving in the military, is the one who is responsible for the care of those two children. The prosecutor’s request for the highest possible sentence was ultimately granted by the judge.
