BARTOW, Fla. — A Florida grandmother at the center of a heartbreaking case involving the death of her 7-month-old granddaughter has been acquitted of aggravated manslaughter but was found guilty on a lesser charge.
Verdict Reached in Emotional Trial
Tracey Nix, a resident of Polk County, was convicted of leaving a child unattended in a vehicle for longer than 15 minutes, causing great bodily harm. The jury, however, did not find her guilty of aggravated manslaughter of a child.
The case revolved around the tragic death of Nix’s granddaughter, Uriel Schock, who died of hyperthermia after being left in a car for hours in November 2022.
“It does sting,” said Uriel’s father, Drew Schock, after the verdict. “I’m thankful, though, that we did get something.”
For Uriel’s mother, Kaila Nix, the outcome brought mixed emotions. “I was relieved to hear that there was going to be accountability and ownership and a conclusion to this part of the story,” she said.
Details of the Incident
In November 2022, Kaila Nix entrusted her 7-month-old daughter, Uriel, to her mother’s care. Tragically, Uriel was left in a vehicle for several hours, during which time the temperature rose to fatal levels.
A medical examiner who testified during the trial confirmed that Uriel’s cause of death was hyperthermia, a condition caused by excessive heat exposure.
Family’s Painful History
This tragedy was not the first devastating loss for the family. Before Uriel’s death, Kaila and Drew had also lost their 16-month-old son, Ezra. In a separate incident, Ezra drowned in a pond after wandering away while Tracey Nix was reportedly asleep.
Due to a ruling by the judge, the jury was not informed about Ezra’s death during the trial. However, for the family, the cumulative pain of losing two children has been overwhelming.
“The destruction that has come from this process is pretty unfathomable as well,” Kaila Nix said. “My kids are dead, but I’ve lost a lot more than that.”
Arguments Presented in Court
The prosecution sought to prove that Tracey Nix’s actions amounted to criminal negligence. They argued that her failure to ensure Uriel’s safety constituted “culpable negligence.”
On the other hand, Nix’s defense attorney, Bill Fletcher, maintained that Uriel’s death was a tragic accident.
“Please don’t make this terrible situation worse by convicting Tracey Nix of something that she’s not guilty of,” Fletcher said during closing arguments.
Reactions to the Verdict
After the jury announced their decision, Fletcher expressed gratitude, describing the acquittal on the aggravated manslaughter charge as a “win.”
“I want to thank the jury,” Fletcher said. “They did their job. They made an appropriate decision in this case. We certainly intend to appeal.”
Fletcher also criticized the judge’s decision to exclude “intent” from the jury instructions for the charge Nix was convicted of, stating that it played a significant role in the outcome.
Sentencing and Possible Penalties
Tracey Nix is scheduled to be sentenced in April and faces up to five years in prison for her conviction.
For the family, the sentencing will mark the next chapter in their pursuit of closure. Despite the outcome, the emotional scars from losing two children remain.
A Community Divided
The case has sparked intense reactions, with some empathizing with Nix’s grief and others calling for accountability for the loss of two young lives under her care.
Child safety advocates have used this case to emphasize the importance of vigilance and awareness when caring for young children, especially in environments with potential hazards.
Reflection and Awareness
This tragedy serves as a somber reminder of the importance of child safety, particularly in preventing heat-related deaths. Experts stress that even a few minutes in a hot car can be fatal for children, whose bodies are more vulnerable to extreme temperatures.
Organizations dedicated to child safety recommend practices such as placing a personal item, like a purse or phone, in the backseat to ensure that caregivers do not accidentally leave a child in the car.
Moving Forward
As the Nix family and the community come to terms with this devastating loss, the hope is that lessons can be learned to prevent similar tragedies in the future.
While the legal proceedings have brought some resolution, the emotional impact on the family will linger for years to come.
