According to officials from the United States, a Guatemalan mother who gave birth to an American baby less than a week ago is currently being held together with her newborn child as she confronts the possibility of being deported.
After unlawfully crossing the border between the United States and Mexico while she was eight months pregnant, the woman was taken into custody by Customs and Border Patrol officials and taken to the hospital, according to a spokesperson for the Department of Homeland Security who stated on Sunday that she was taken into custody.
The hospital was the location where she gave birth “under supervision,” according to the spokesman. The spokesperson went on to say that she was released from the hospital by the medical staff and had been transferred to the custody of Immigration and Customs Enforcement while she is waiting for a court date.
In a separate statement released on Saturday, a representative for the Customs and Border Protection (CBP) stated that the woman “illegally crossed into the United States from Mexico between ports of entry near Tres Bellotas Ranch” in Arizona the previous week.
The area is on federal territory, approximately 72 miles south-southwest of Tucson, and is situated along a lonely stretch of the Sonoran Desert. It is located just north of the border between the United States and Mexico.
After being admitted to the hospital, the spokesperson for the Customs and Border Protection stated that “processing” had been finished, and the mother, who remained nameless, was handed a summons to appear before an immigration judge. Following the conclusion of the processing, the spokeswoman stated that she was provided with the opportunity to get in touch with a legal representative.
“This morning, custody of the woman was transferred to ICE Enforcement and Removal Operations with a court date to appear before an immigration judge,” the spokesperson for CBP told reporters on Saturday. “The child remains with the mother.”
On Friday, an attorney for the woman, Luis Campos, disclosed to the NBC affiliate KVOA of Tucson that his client had given birth on Wednesday and that he had been denied access to her while she was receiving medical treatment at Tucson Medical Center.
There was a request for comment made on Sunday, but a spokeswoman for the medical center did not immediately react to the request.
According to a report that was published by Reuters on Saturday, the mother “avoided fast-track deportation after intervention by” Arizona Governor Katie Hobbs, who is a Democrat and who was claimed to have interfered by the magazine.
“While Governor Hobbs is in favor of securing the border, she has made it abundantly clear that she is opposed to inhumane immigration enforcement practices,” said Liliana Soto, the spokesperson for Governor Hobbs, on Friday on X. It is the intention of the governor to continue his efforts to safeguard the constitutional rights of every Arizonan and to ensure the safety of our communities.
On Sunday, a request for additional information was sent to the press office of Hobbs, but they did not immediately answer.
The spokeswoman for the Customs and Border Protection stated on Saturday that the mother did not have the access to legal representation until the processing of her case was finished and she had a court date.
Although the statement made by the spokesman noted that the woman has a kid, it did not mention that she had recently given birth while she was in custody. It stated that she was “eight months pregnant” when she was taken into custody north of the border between the two countries.
Following the completion of the processing and the establishment of a notice to appear, the spokesman stated that “she was immediately given the opportunity to contact an attorney.” At all occasions, agents complied with the law and followed the protocols established by the CBP. There was no refusal of any privileges.”
In a statement released on Sunday, the spokeswoman for the Department of Homeland Security acknowledged that the woman had entered the United States with a “unborn child.” It described her as having been “rescued” by agents from the California Border Patrol.
DHS and CBP have both reported that the child has remained with her.
This is despite the fact that the newborn is a natural-born citizen of the United States, according to Campos, who believes that the lady will be deported and that her child will be removed along with her. “The child will probably go with her,” he predicted to KVOA.
He stated that he intends to submit an asylum application on behalf of the woman because she was concerned for her life in Guatemala.
As a result of a lack of employment possibilities in their native country, tens of thousands of Guatemalans have made the journey north to the United States, according to experts. This migration is a result of the escalating violence in Mexico along its border with Guatemala, where Guatemalans are known to perform seasonal jobs in agriculture.

According to a lawyer who represents one of the families, the moms, on the other hand, stated that they were not given any other option but to keep their children with them while they were being deported.
The administration of President Trump has also attempted, through the use of an executive order, to put an end to the type of birthright citizenship that can be conferred to the newborn child of a Guatemalan woman. Birthright citizenship is a form of automatic U.S. nationality that is granted to practically anybody who is born in the United States or any of its territories.
The order was put on hold by the federal courts, and the administration has asked the Supreme Court of the United States to intervene in an emergency situation. The case is due to be heard on May 15th.
